WWW.RamakshatriyaMatrimonial.com hereinafter referred to as ‘RM’ is a matrimonial website serving as an information website for match-making exclusively for Ramakshatriya Community by M/S Ashlesha Services Udupi.

Every User of this website PLEASE READ THE FOLLOWING TERMS AND CONDITIONS VERY CAREFULLY BEFORE USING THE WEBSITE. ACCESSING, BROWSING OR OTHERWISE USING THE WEBSITE IMPLIES YOUR AGREEMENT TO BE BOUND BY ALL THESE TERMS AND CONDITIONS ("Agreement"). If you do not want to be bound by the terms and conditions, you must not use the RM Website or the RM Services. The terms and conditions also include the applicable policies which are incorporated herein by way of reference and as amended from time to time (the "Terms and conditions").

Every user of this website is bound to agree the terms and conditions below.

In order to use the RM website ("Site"), you must register as a member of the site ("Member") and agree to be bound by these terms of use ("Agreement") and the privacy policy. If you wish to become a member and communicate with other members and make use of the RM ("Service"), read these terms of use and follow the instructions in the registration process. This Agreement sets out the legally binding terms between you as a member and the owner of the site M/s Ashesha Services, Udupi. This Agreement may be modified by RM from time to time, effective upon notice to you as a Member.

In these Terms, references to "RM member" shall mean the end user accessing the website/RM services, its contents or using the RM services offered. RM member also includes persons such as father, mother, brother, sister, relative or a friend ("Registrant") of the prospective bride/ bridegroom. The terms "You" and "User" shall be interchangeably used for "RM member". "RM Services" means a collective reference to the RM service provided by M/S Ashlesha Services Udupi.

1.Scope

RM acts as a platform to enable any user to themselves register on it (by filling the mandatory fields and optional fields, if any) to voluntarily search for profile(s) from the database of RM’s already registered users, for seeking prospective lawful matrimonial alliances for themselves. RM retail store may also be able to assist you to create your profile, however, you must have a valid/operational mobile phone number and an email id. The profiles in the database of RM are classified broadly on the basis of language and region for the ease and convenience of its member / customer. RM Members are provided with free/paid access for searching profiles from the database of RM, as per the partner preference set by you (on the Website/Applications - (App) and you can shortlist the profiles in which you are interested.

2. Eligibility

A) RM Membership and rights of admission is reserved solely for Ramakshatriya community

• Indian Nationals & Citizens
• Persons of Indian Origin (PIO)
• Non Resident Indians (NRI).
• Persons of Indian Descent or Indian Heritage
• Persons who intend to marry persons of Indian Origin

B) Further in capacity as RM member you confirm that you are :

• As per the Indian Marriage Act, you should be at least 18 years of age for women and 21 years for men. By using this site, you
  represent and warrant that you have the right, authority, and capacity to enter into this Agreement and to abide by all of the terms and
  conditions of this Agreement
• If you have applied for Divorce, you may register on our website/App by stating "Awaiting Divorce".
• If you are Ramakashtriya community and you are a resident of any other country, you are legally competent to marry as per the local
  rules applicable to your country and you shall comply with the Indian laws for marrying a person of Indian Origin

C) In case you are a Registrant of the prospective bride/ bridegroom and has created profile in RM Website/App on behalf of them or is accessing the RM Website/App on behalf of them implies that you have taken their consent for their profile creation in RM and for accessing the RM Website/App.

3. Registration & Regulations of your “USER” Account

We expect that you would complete the online registration process with fairness and honesty in furnishing true, accurate, current, complete information and with providing recent photos of you which will help you to meet your parameters .We expect you to read the relevant column before keying in the details or selecting the option available or uploading the photo

This Agreement will remain in full force and effect until

• You use the Site and/or are as a Member of RM.
• You terminate your membership at any time, for any reason by writing to RM or by choosing the option to terminate in the website.
• RM terminates your access to the Site and/or your membership for any reason effective upon sending notice to you at the email
  address that you have provided in your application for membership or your updated email address on our website.
• RM terminates your membership in the RM Service because for having breached the Agreement by the member.
• 5. Upon non-activity on the website from the member for more than 365 days.

For what-so-ever reason if the membership is terminated by you / RM, you will not be entitled to any refund of any unused Subscription fees. Even after this Agreement is terminated, certain provisions will remain in effect including all sections inclusive, of this Agreement.

You are responsible for all activities that occur under your account and password. Please maintain the confidentiality of your account and password and for restricting access to your computer systems.

In the event that your profile is created by a family member or friend, you will be responsible for the content posted by such other person. RM is not obligated to verify the veracity and accuracy of information displayed by you.

You also hereby expressly agree that the information provided by you is available to the other users of RM. RM neither has any control nor any responsibility or accountability if your information is misused, exploited or abused by any third party.

You are permitted to have only one user profile. In the event of multiple user profiles of a single member, we reserve the right to deactivate any such or all profiles.

If at any point of time, RM comes to know or is so informed by third party or has reasons to believe that any information provided by you for registration (including photos) or otherwise is found to be untrue, inaccurate, or incomplete, RM shall have full right to suspend or terminate (without any notice) your RM membership and forfeit any amount paid by you towards RM membership fee and refuse to provide RM service to you thereafter.

RM also reserves the right to block the registration of your profile on Website/App, if any, in the case of your contact details/links being entered in irrelevant fields or if there are errors in any data entered by the RM members in their profile.

Registration of duplicate profiles of the same person is not allowed in RM Website/App. RM shall have full right to suspend or terminate (without any notice) such duplicate profile.

You acknowledge and confirm that your registration with RM and the usage of RM services is with the bonafide intention of marriage and not otherwise. RM Membership is restricted strictly to the registered RM individual member only. Organizations, companies, businesses and/or individuals carrying on similar or competitive business cannot become Members of RM and nor use the RM Service or RM members data for any commercial purpose, and RM reserves its right to initiate appropriate legal action for breach of these obligation.

You will not send any messages to other Members that are obscene, lewd, licentious, and defamatory, promote hatred and/or are racial or abusive in any manner. Transmission of any such messages shall constitute a breach of this Agreement

This site is not meant to encourage and/or promote illicit sexual relations or extra marital affairs. If RM discovers or becomes aware that any member is using this site to promote or engage or indulge in illicit sexual relations or extra marital affairs, his/her membership will be terminated forthwith without any refund and without any liability to RM. RM's discretion to terminate shall be final and binding.

Limitations of use / service for Free member and paid member are described in the subscription section of the website. It is at the sole discretion of RM to add / modify the limitation of services for different kind of members. Please refer to the Subscription section for further details.

4. Account Security

You are responsible for safeguarding the confidentiality of your RM login credentials such as your user id, password, OTP, etc., and for restricting access to your computer/mobile to prevent unauthorized access to your account. We, as a Company do not ask for password and you are cautioned not to share your password to any persons. You agree to accept responsibility for all activities that occur under your account

5. Non-Commercial Use by Members.

RM website and its services are for the personal use of individual members only and may not be used in connection with any commercial purposes. Any kind of commercial organizations / companies / businesses establishments / social groups cannot become the member of this site.

We may also immediately terminate your membership from the Website if we have reason to believe that you are not eligible to use the Website or you are using the Website for unauthorized purposes. Illegal and/or unauthorized uses of the Site, including unauthorized framing of or linking to the Site will be dealt with in accordance with law.

You will not transmit any chain letters or junk email to other RM. It is also a violation of these rules to use any information obtained from the Service in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to any Member without their prior explicit consent.

In order to protect RM and/or our Member(s) from any abuse / misuse, RM reserves the right to restrict the number of communications / profile contacts & responses / emails which a Member may send to other Member(s).

You may not use any automated processes, including IRC Bots, EXE's, CGI or any other programs/scripts to view content on or communicate / contact / respond / interact with RM and/or its members.

RM contains the logo, Graphics, page headers, button icons, Software(s), Script(s), copyrighted material, trademarks, intellectual property rights and other proprietary information. Except for that information which is in the public domain or for which you have been given permission, you may not copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information.

6. Proprietary rights in the Content Posted on the Site.

Your profile details, photos, Horoscope, videos, communications and messages collectively hereinafter called as “Content”.

You are solely responsible for the Content that you publish or display (hereinafter, "post") on RM, or transmit to other RM Members. RM reserves the right to verify the authenticity of Content posted on the site. In exercising this right, RM may ask you to provide any documentary or other form of evidence supporting the Content you post on the site. If you fail to produce such evidence, RM, in its sole discretion, terminate your Membership without a refund.

To publish/modify/ delete any of its part/complete is the sole judgment of RM for which the content might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of other RM and/or its Members.

By posting Content on RM, you automatically grant, and you represent and warrant that you have the right to grant, to RM and other RM(s), an irrevocable, perpetual, non-exclusive, fully-paid, worldwide license to use, copy, perform, display, and distribute such information and content and to prepare derivative works of, or incorporate into other works, such information and content, and to grant and authorize sublicenses of the foregoing.

Every Profile created by the user will be scrutinized by our team for correctness of the contents. Minor corrections such as spelling mistake, unnecessary characters etc. and minor editing of photos such as cropping and resizing, adjusting brightness and contrast will be done by the team. The team ensures to correct / complete the profile by calling the contact person on the mentioned mobile number given at the time of registration. In such cases we advise the member to verify the contents immediately after it. In case of any changes the member can correct the same by logging on to the website with his username and password or inform us by mail / phone to do so.

The following is a partial list of the kind of Content that is illegal or prohibited on the Site. RM will investigate and take appropriate legal action in its sole discretion against anyone who violates this provision, including without limitation, removing the offending communication from the Service and terminating the Membership of such violators without a refund. You must use the RM Service in a manner consistent with any and all applicable local, state, and federal laws and regulations.

You may not include in your Member profile, visible to other members, any telephone numbers, street addresses, last names, URL's, and email addresses.

Membership Policy

RM reserves the right to Approve, Disapprove, Activate, Deactivate, discontinues the user as Free / Paid member to its website at any time. Following are partial list the user / member policies that every member must agree and follow

You, shall safeguard your profile information by creating a strong password during profile creation with combination of alphabets, both upper and lower case and numbers.

Any information / data required by RM for using the RM services shall be provided by the RM Member, as and when so sought by RM.

You are requested to verify the credentials of the prospect, exercise due care and caution regarding their profile information which includes marital status, educational qualifications, financial status, occupation, character, health status, etc. and satisfy yourself before making a choice of your match. RM shall not be liable for short coming due to any misrepresentations made by any of its RM members.

To get better search results, RM Members are expected to provide latest photograph which should not be more than 3 (three) months old. Providing old photographs/ photographs of others, inaccurate / false information shall be treated as violation of terms and conditions and RM shall retain their right under clause 3(H) of this terms and conditions.

RM members are expected to disclose their health records during profile enrollment which includes any pre-existing illness, physical disability etc. Non - disclosure at the time of enrollment shall be treated as violation of the terms and conditions and RM shall retain their right under clause 3(H) of this terms and conditions.

RM Members are advised to refrain from

• Entering into any financial transactions with prospects. RM Members shall not seek financial help or provide financial help from / to the
  other RM Members
• Using abusive language when they communicate with the other RM Members
• being discriminative or using racial comments etc.
• Sharing of confidential and personal data with each other but not limited to sharing of bank details, etc.
• Entering into physical relationship with any prospect before marriage.
• violating any law for the time being in force.
• From mentioning details of other matrimonial services while sending personalized messages

RM Members are expected to be cautious of prospects who ask for favors, money etc or call from multiple phone numbers, only interact over phone, doesn't come forward for face to face meeting (physically or through video calls) and don’t involve family and friends in match making. Beware of suspended profiles status before you finalize an alliance with the prospect.

The RM members agrees that for getting effective search results of prospects on Website/App you will regularly log in to the profile maintained in the Website/App and send expression of interest which is an automated messages to prospects as a free RM member, and in the event you have availed paid RM package, you can send personalized messages to prospects to show your expression of interest/replies. RM member also may review the expression of interest sent to you / read the messages sent to you by prospects and may respond suitably.

You also agree that while accessing / using the Website/App, you will be guided by the terms and conditions of the Website/App including but not limited to the use of feature of website /App like chat instantly with prospect, viewing horoscope of prospects, enhancing privacy settings (photo/horoscope/phone number) or for viewing social and professional profile of members on their Facebook, LinkedIn, etc.

If the RM Member fails to update in RM website/App, any change in the particulars furnished in their profile/ then the RM membership may be suspended by RM at its sole discretion.

K. RM member shall, in case of finalization of his/her/their Registrant’s marriage, delete their profile by themselves or intimate RM for removal/deletion of their profile.

RM Members agree to use secure devices, software and networks in a private place for accessing the RM services.

RM member shall not use any kind of Bots like web robots, Chatbot or any other automated processes/programs/scripts to use, communicate or respond in RM Website/App.

RM Members shall not probe, scan or test the vulnerabilities of the RM Website/App or any network connected to the Website/App nor breach the security measures instituted by RM.

You shall also not make any payment / transfer any amount to account of any Ashlesha services employees. All payments shall be made only to RM account.

Every member must get registered to the site providing the details of the individual as per the fields provide on the website. Initially everyone will be registered as a free user. Upon the confirmation of the receipt of the payment for paid membership, free member will be upgraded / transferred as “Paid Member”.

RM does not guarantee / authenticate the genuineness of the contents provided by the member. Every member submitting his/her matrimonial profile is required to give all the facts essential for establishing a marital relation. Concealing facts relevant to marriage could result in loss or damage to any individual and for which, RM cannot be held responsible / liable in any way for the damages caused due to incorrectness of the information provided by its members regarding the religion, caste or creed or any other personal information. If the members’ profile is deemed to be unfit, RM has the right to delete, alter or refuse the same at any point of time without any notice.

RM does not facilitate / hold responsible for connection with other member. You are only liable for your connections with other members.

Contact information of member’s profile will display only to paid members with the permission of other member. Free membership is for limited time. RM reserves right to discontinue free membership at any time.

Members will not have any claim against RM for any time delay in posting their information into RM website due to any technical reasons.

RM will not mediate / arbiter, hold any moral / legal responsibility for any kind of disputes between its members.

RM will not guarantee the members that you as an applicant will receive responses and hence cannot be held responsible for no replies. In this case we cannot give any refunds or credits.

By becoming a Member of the RM, you agree to receive certain specific Telephone / Mobile calls, emails and SMS from RM on the telephone / mobile number and e-mail ID provided by you on your profile explain, explicate and clarify the various services and to assist, aid or support you in availing the said services of RM. You can always manage your subscription to the emails and SMS using the option provided at the site.

You are representing that you or the mobile number submitted by you is not registered with the Do Not Disturb / National Customer Preference Register and/or you have already changed your registration suitably. Further and in any event, you do hereby also unconditionally agree and undertake that this invitation and solicitation shall supersede any preferences set by you with or registration done with the Do Not Disturb ("DND Register")/ National Customer Preference Register ("NCPR"). Without prejudice to the aforesaid and in any event, by expressly inviting and soliciting the services from RM, you also unconditionally agree that your rights under the Telecom Commercial Communications Customer Preference Regulations, 2010 or any subsequent amendments thereto or under NCPR, are kept in abeyance or remain extinguished till you expressly communicate for discontinuation of relationship.

You are under an obligation to report any misuse or abuse of the Site. If you notice any abuse or misuse of the Site or anything which is in violation of this Agreement, you shall forthwith report such violation to RM by writing to Customer Care. On receipt of such complaint, RM may investigate such complaint and if necessary, may terminate the membership of the Member responsible for such violation abuse or misuse without any refund of subscription fee. Any false complaint made by a Member shall make such Member liable for termination of his / her membership without any refund of the subscription fee.

Once your membership with us expires, you will not be able to access your personalized messages sent, and mobile numbers viewed by you. We request you to save all your contacts you had contacted already and upgrade your membership with us to enjoy access to these features.

• There is a limit to the number of profiles you are allowed to contact each during the period of membership. Please refer to the Subscription
  Page of the website for further details.
• Messages sent to members of the opposite gender should be only for the purpose of finding a marriage alliance / life partner. You are not
  allowed to misuse the services of RM in the name of "Dating", "Flirting", "Friendship" etc.
• Upon termination / cancellation / change in type of membership by you / RM the contents of your profile will remain in our database
  and such details may not be available to the public in any form.

8. Copyright Policy.

You may not post, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior written consent of the owner of such proprietary rights. Without limiting the foregoing, if you believe that your work has been copied and posted on the RM service in a way that constitutes copyright infringement, please provide our Copyright Agent with the following information: an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest; a description of the copyrighted work that you claim has been infringed; a description of where the material that you claim is infringing is located on the our Site; your address, telephone number, and email address; a written statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; a statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf. 9. Disputes between Members

You are solely responsible for your interactions with other RM Members. RM reserves the right, but has no obligation, to monitor disputes between you and other Members.

10. Disclaimers.

RM is not responsible for any incorrect or inaccurate content posted on the Site or in connection with the RM service, whether caused by Users, Members or by any of the equipment or programming associated with or utilized in the Service, nor for the conduct of any User and/or Member of the RM service whether online or offline. RM assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, User and/or Member communications.

RM is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, failure of e-mail or players on account of technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to Users and/or Members or to any other person's computer related to or resulting from participating or downloading materials in connection with the RM Site and/or in connection with the RM service.

Under no circumstances will RM be responsible for any loss or damage resulting from anyone's use of the Site or the Service and/or any Content posted on the RM Site or transmitted to RM Members. The exchange of matrimonial profile(s) through or by RM should not in any way be construed as any matrimonial offer and/or recommendation from/by RM. RM shall not be responsible for any loss or damage to any individual arising out of, or subsequent to, matrimonial relations established pursuant to the use of RM. The Site and the Service are provided "AS-IS" and RM expressly disclaims any warranty of fitness for a particular purpose or non-infringement. RM cannot guarantee and does not promise any specific results from use of the Site and/or the RM Service.

11.Limitation on Liability.

Except in jurisdictions where such provisions are restricted, in no event will RM be liable to you or any third person for any indirect, consequential, exemplary, incidental, special or punitive damages, including also lost profits arising from your use of the Site or the RM Service, even if RM has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, RM, liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to RM, for the Service during the term of membership.

12.Disputes.

If there is any dispute about or involving the Site and/or the Service, by using the Site, you agree that the dispute will be governed by the laws of the State of Karnataka, India without regard to its conflict of law provisions. You agree to personal jurisdiction by and venue in the competent courts in Udupi, India only.
